Where a patent, trademark, copyright, trade secret or Internet Domain Name represents one of the principal assets of a company seeking venture capitol, angel funds, financing or other funding, common sense demands a careful review to determine the validity and enforceability of such a critical asset. Courts (and certain administrative agencies) may cancel an issued patent, trademark or copyright (or order an Internet Domain Name transferred) if they find that such should not have been issued in the first place, due to prior art, earlier use, or other reasons.
